1. Acceptance of TermsBy accessing or using the Klettra mobile application ("App"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with these Terms, please do not use the App.
2. Definitions"User" means any individual or entity accessing the App. "Content" includes all data, images, videos, logs, and other materials that you submit or generate. "Services" refers to the functionalities provided by the App, including climbing activity tracking, image and video uploads, and related features.
3. User Responsibilities and Account SecurityYou are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately if you suspect any unauthorized access or breach of security.
4. User Content and LicenseBy submitting any Content—including images and videos of your climbing attempts and activity logs—you grant Klettra a worldwide, non-exclusive, royalty-free license to use, display, reproduce, modify, and distribute such Content for the purposes of operating, promoting, and improving the App. You affirm that you have all necessary rights and permissions to submit such Content.
5. Prohibited ContentYou agree not to upload, share, or distribute any Content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable. This includes, but is not limited to, videos or images that infringe on intellectual property rights or contain explicit material. Klettra reserves the right to remove any Content that violates these Terms and to terminate the accounts of repeat infringers.
6. Safety DisclaimerClimbing is inherently dangerous. The App is intended solely as a tool for tracking and recording your climbing activities and does not substitute for professional training, equipment, or safety practices. Use the App at your own risk.
7. Disclaimer of WarrantiesThe App and its Services are provided on an "AS IS" and "AS AVAILABLE" basis. Klettra expressly disclaims any warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
8. Limitation of LiabilityUnder no circumstances shall Klettra, its officers, directors, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App, even if advised of the possibility of such damages.
9. IndemnificationYou agree to indemnify, defend, and hold harmless Klettra and its affiliates from any claims, damages, liabilities, or expenses arising from your use of the App or your breach of these Terms.
10. Modification and TerminationWe reserve the right to modify these Terms at any time, with any changes effective immediately upon posting. Your continued use of the App following any changes constitutes your acceptance of the new Terms. Additionally, we may suspend or terminate your access to the App for violations of these Terms.
11. Governing Law and Dispute ResolutionThese Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction. Any disputes arising under these Terms shall be resolved exclusively in the appropriate courts within that jurisdiction.
